Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TrailR mobile application and related services (the "Service") provided by TrailR ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your Account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account. You may not impersonate others or select a username that is offensive, infringing, or misleading.

3. Acceptable Use

You agree not to:

• Post or share content that is unlawful, harassing, hateful, defamatory, sexually explicit, or otherwise objectionable;
• Harass, bully, threaten, or harm other users;
• Post spam, advertisements, or repeated unsolicited content;
• Infringe the intellectual property or privacy rights of others;
• Attempt to access accounts or data that do not belong to you;
• Reverse engineer, scrape, or interfere with the Service or its infrastructure;
• Use the Service to violate any applicable law or regulation; or
• Circumvent any moderation, safety, or rate-limiting features.

We may remove content, issue warnings or strikes, restrict features, or suspend or terminate accounts that violate these Terms, at our discretion.

4. User Content

You retain ownership of the content you create on the Service, such as lists, reviews, and comments ("User Content"). By posting User Content, you grant TrailR a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating and improving the Service. You represent that you have the rights necessary to grant this license and that your User Content does not violate these Terms or any law.

5. Content Moderation

The Service includes features that allow users to report content, block other users, and mute activity. We may review reported content and take action consistent with these Terms. We are not obligated to monitor all content, and we are not responsible for User Content posted by others. Repeated or severe violations may result in permanent removal from the Service.

6. Third-Party Content and Services

The Service displays movie metadata, posters, and trailers sourced from third parties, including The Movie Database (TMDB) and YouTube. This content is the property of its respective owners and is subject to their terms. TrailR is not affiliated with or endorsed by these parties. We do not guarantee the accuracy, availability, or legality of third-party content, and your use of it may be subject to additional terms.

7. Intellectual Property

The Service, including its design, features, logos, and software (excluding User Content and third-party content), is owned by TrailR and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your information. By using the Service, you consent to those practices.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content will be accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, TrailR and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (USD $100).

11. Indemnification

You agree to indemnify and hold harmless TrailR from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice within the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which TrailR is established, without regard to conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless otherwise required by applicable law.
